Yes, you can with the generic driver. You can use Real-Time capabilities with 
preempt-rt and the generic driver.

You can use your kernel version, but you have to install the kernel header. 
Configure with
./configure --enable-generic --disable-8139too --with-linux-dir=your_path_to_kernel_header
