Please note,

Kernel code is under GPLv2
User space code is under LGPL.

So application code in userspace can be closed source.
But generally no license costs.

A native driver implementation is normally based on kernel code, so in
most cases GPLv2. So you have to open your your driver code.
And of course the project has a benefit of your driver and many more
people can review and fix your code.
